Welcome to Server Maker! By adding, accessing, or using the Server Maker Discord bot ("Bot") and any associated services or websites ("Services"), you ("User," "you," or "your") agree to comply with and be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you must not use our Bot or Services.

1. Agreement to Terms

Your use of the Bot constitutes your binding agreement to these Terms, our Privacy Policy, and any other relevant policies. You also agree to comply at all times with the Discord Terms of Service and Discord Community Guidelines.

2. Description of Services

Server Maker provides a suite of tools to assist in creating, managing, and automating Discord servers. Features include, but are not limited to, AI-powered server generation, aesthetic revamps, server cloning, user-created server templates, private backups, and automation modules for community management.

3. User Responsibilities and Conduct

  • Eligibility: You must be at least 13 years of age and of the legal age required by your country of residence to use Discord and our Bot.
  • Authorized Use: Commands that perform destructive or server-altering actions (e.g., /build, /clone, /edit) must only be used by users with explicit authorization from the server owner.
  • Prohibited Activities: You agree not to use the Bot to:
    • Engage in any activity that violates any applicable law or the Discord Terms of Service.
    • Attempt to maliciously exploit, reverse engineer, decompile, or gain unauthorized access to our systems or source code.
    • Generate or promote hateful, harassing, illegal, or Not-Safe-For-Work (NSFW) content, especially through our AI features.
    • Create an unreasonable load on our infrastructure or otherwise disrupt the Service for others.
  • Responsibility for Content: You are solely responsible for the content you generate, including AI prompts and the templates or backups you create. We are a passive conduit for your content.

4. Acknowledgment of Risk for Destructive Commands

Certain commands within the Bot are designed to perform significant, irreversible actions that will permanently delete parts or all of your server's structure (channels, roles, etc.). These commands include, but are not limited to, /build, /clone, and /edit. By using these commands, you acknowledge and agree that:

  • You are using these features at your own risk.
  • You understand that these actions are irreversible and we cannot recover deleted data.
  • Server Maker is not liable for any data loss or damage to your server resulting from the use of these commands. We strongly recommend creating a manual backup before performing any such action.

5. Intellectual Property

  • Our Property: Server Maker and its associated assets, including its name, logo, branding, and proprietary code, are the exclusive property of its owner(s) and are protected by intellectual property laws.
  • Your Property: You retain ownership of the content you create, such as the server templates and backups you save. By making a template public, you grant us a worldwide, royalty-free license to distribute, display, and allow other users to download and use that template as part of our Service.

6. Service Availability and Modifications

  • Availability: We strive for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or other unforeseen issues.
  • Modifications: We reserve the right to modify, add, remove, or discontinue features of the Bot at our sole discretion, at any time, with or without prior notice.

7. Disclaimers and Limitation of Liability

  • The Bot and all associated Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
  • We do not guarantee that the Service will be error-free, secure, or that the AI-generated content will be accurate or suitable for your purpose.
  • The backup feature is provided as a convenience and is not a guaranteed, foolproof archival solution. We are not liable for any data loss resulting from a failed or corrupted backup.
  • To the maximum extent permitted by law, Server Maker and its owner(s) shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Bot.

8. Termination

We may terminate or suspend your access to our Bot and Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Abusive use of the AI features or infrastructure is a direct cause for termination. You can terminate your agreement to these terms at any time by simply removing the Bot from all servers you control.

9. Changes to These Terms

We reserve the right to revise these Terms at any time. The most current version will always be available on this page, indicated by the "Effective Date" at the top. By continuing to use the Bot after revisions become effective, you agree to be bound by the updated Terms.
